1. PARTIES AND LEGAL RELATIONSHIP
1.1 Definitions: "Horizon Rides," "we," "us," or "the Company" means, trading as Horizon Rides, a business registered under the Registration of Business Names Act, Chapter 13:03 of the Laws of Saint Lucia. "User," "you," or "your" means any person accessing the Services, including both Drivers and Passengers.
The Dispatch Coordination Model
Horizon Rides operates exclusively as a third-party dispatch and booking coordination service. We are an intermediary that connects Passengers seeking transportation with independent Drivers who provide that transportation using their personal vehicles. We do NOT provide transportation services ourselves.
2. TERMS FOR PASSENGERS
2.1 Eligibility: You must be at least 18 years old to use Horizon Rides as a Passenger. Passengers under 16 must be accompanied by a parent or guardian.
CRITICAL INSURANCE WARNING:
Drivers maintain personal auto insurance which likely EXCLUDES coverage for paid trips. You voluntarily assume all risks associated with transportation from independent contractors.
3. TERMS FOR DRIVERS
3.1 Independent Contractor Status: You are an independent contractor operating your own private hire transportation business. You are NOT an employee of Horizon Rides. You control your own schedule and routes.
3.4 Compensation: Drivers receive 85% of the total fare. Horizon Rides retains a 15% commission fee. All earnings are subject to a 21-day hold period for security purposes.
4. GENERAL PROVISIONS
4.2 Binding Arbitration: All disputes shall be resolved exclusively through final and binding arbitration in Castries, Saint Lucia, pursuant to the Arbitration Act of Saint Lucia, Chapter 5.01.
4.3 Limitation of Liability: Total aggregate liability shall not exceed the greater of fees paid in the last 12 months or XCD $2,500.
